WARRANTY

Initial Deposit Requirements: A 50% deposit of the total project cost is required prior to beginning any work. This deposit ensures the reservation of your project start date and covers initial materials and labor costs. The remaining balance will be due upon completion of the project. Please note that work will not begin until the deposit has been received. Deposits are fully refundable less 10% of the deposit for return and restocking fees.

3-Year Limited Warranty


This document ("Warranty") sets forth the terms and conditions of the 3-Year Limited Warranty ("Warranty") provided by Husky Concrete Resurfacing LLC (hereinafter referred to as "Husky Concrete Resurfacing") for its coating installations in various applications. By availing this Warranty, you, the original purchaser of the product, hereby agree to be bound by the following provisions:

Enhanced Definitions


Warranty Period: The term "Warranty Period" refers to the period beginning with the installation of the product and continuing for (3) years from the date of substantial completion.

Substantial Completion: "Substantial completion" occurs on the date when the installation of the coating is completed and ready for its intended use. This typically aligns with the date that the remaining balance for the project is collected by Husky Concrete Resurfacing.

Delamination: "Delamination" is defined as the separation of the coating layers, resulting in visible flaking, peeling, or detachment of the coating from the concrete substrate.

Defects: For the purposes of this warranty, defects are imperfections that materially impair the function or use of the product. This includes defects in materials or workmanship that are present at the time of installation or that manifest during the Warranty Period under normal use conditions.

Normal Use: Refers to the regular activities and conditions for which the product is designed, including everyday traffic and operations in residential, commercial, or industrial settings, consistent with the product’s intended purposes. It excludes activities involving excessive mechanical stress, abnormal chemical exposure, or misuse beyond the product’s specified capacity and recommended maintenance practices.

Repairs: Actions taken to correct any defects covered under this warranty, which may include patching, re-coating, or completely reapplying the product, depending on the nature and extent of the defect. It is expressly acknowledged and understood that due to the nature of the repair process, there may be inherent variations, and the repaired area may not precisely resemble the original surface in appearance. These variations are considered acceptable under the terms of this warranty and do not constitute a defect.

Coverage
Husky Concrete Resurfacing offers a limited warranty that covers any defects in materials or workmanship for the Warranty Period under normal use conditions. This warranty includes protection against delamination, cracking, peeling, chipping of the coating surface, and substantial discoloration due to UV exposure.

Coverage Scope and Duration
This section of the warranty specifies the maximum square footage covered under the warranty and the duration of coverage for various use cases:

Residential Garages and Basements: The warranty covers up to 5000 square feet for a period of three (3) years from the date of substantial completion.

Commercial, Industrial, or Business Use Buildings: The warranty covers up to 5000 square feet for a period of three (3) years from the date of substantial completion.

Exterior Surfaces: The warranty covers up to 5000 square feet for a period of three (3) years from the date of substantial completion.

Any Coating Excluding a Primer or Moisture Vapor Barrier: The warranty covers up to 5000 square feet for a period of one (1) year from the date of substantial completion, applicable to any coating that does not use an epoxy primer or moisture vapor barrier, regardless of where the coating was installed.

Replacement is limited to the original cost of materials or replacement, at the sole option of Husky Concrete Resurfacing. Such original cost of materials or replacement of failed areas, at Husky Concrete Resurfacing’s sole option, shall be the only responsibility of Husky Concrete Resurfacing under this warranty. Husky Concrete Resurfacing reserves the right at all times to inspect the claimed defective material and verify warranty coverage at its factory laboratory. The customer shall be responsible for the remainder of any costs of installation or product price increase over and above the original purchase price.

Exclusions
Customer Negligence: This warranty does not cover various forms of damage that can arise due to negligence. Damage from chemical exposure or heat such as grease, oil, gasoline, transmission fluid, battery acid, paint stripper, detergents, industrial solvents, tire plasticizers, hot or spinning tires, and direct exposure to flames is not covered. Additionally, damage from mechanical sources or improper cleaning methods including the use of pressure washers, scrubbing or buffing machines, abrasive cleaning methods, or harsh detergents are excluded from coverage. The warranty also excludes physical damage such as scratches and impact damage, as well as any discoloration or dullness that results from lack of cleaning, rust, or excessive use. (Note: The coating requires up to 72 hours under normal climatic conditions to fully cure and achieve its maximum strength.)

Concrete Issues: The warranty does not cover issues arising from the concrete substrate, including cracking, re-cracking, heaving, shifting, popping, settling, or geo-movement and/or structural foundation movement. Our warranty excludes moisture-related issues, including intrusion, efflorescence and hydrostatic pressure as well as bonding issues over areas saturated with substances including but not limited to oil and battery acid. (Note: We do not change the pitch of the concrete or level it in any circumstance.)

Waterproofing: While the coating enhances protection against moisture, it is not a waterproofing solution. There is no warranty coverage for water leakage or moisture intrusion to areas below the treated surface.

Appearance, Texture, and Surface Conditions: While efforts are made to minimize the visibility of pre-existing damage and imperfections in the concrete, some may still be visible after application. Additionally, the texture of foundation or stem walls may differ from that of the floor. This warranty does not cover issues arising from pre-existing low spots or inadequate drainage on the concrete surface. These conditions are considered inherent to the pre-existing state of the concrete and are outside the scope of warranty coverage.

Inaccessible Areas: This warranty does not cover areas that are reasonably inaccessible for grinding, such as deep into corners, under permanent fixtures or furniture, or foundational/stem walls.

Accidents, Casualties, and Natural Disasters: This warranty does not cover damages resulting from any accidents, casualties, or natural disasters, such as fires, floods, earthquakes, and other severe weather conditions.

Claim Process
To file a warranty claim, customers must contact Husky Concrete Resurfacing directly by phone (+1 603 234 5895) or email (cam@huskyconcreteresurfacing.com) and submit photos and other relevant evidence within fifteen (15) days of identifying the defect. The company will assess the claim within thirty (30) days and, if validated, will perform necessary actions.

Terms of Modification
Please note that any alterations or modifications made to your epoxy flooring by someone other than Husky Concrete Resurfacing that affects the product's integrity will void this warranty. It is crucial to consult us before undertaking any such changes to maintain your warranty coverage.

Additional Provisions
The warranty is only valid for the original purchaser and cannot be transferred.
Repairs made under the warranty do not extend the original warranty period for the initial installation or any individual part thereof.
Customers are encouraged to maintain their coated surfaces by cleaning spills promptly and avoiding the use of non-breathable mats and harsh cleaning tools.
Any surface can be slippery, especially when wet with any fluid. In no event shall Husky Concrete Resurfacing be responsible for injury incurred by a slip or fall situation. It is the purchaser’s responsibility to provide for their own safety and the safety of their guests. While slip-resistant additives assist slip/fall prevention, there is no guarantee that someone will not slip while walking on coated areas.
Legal Rights
This limited warranty provides you with specific legal rights, but you may have other rights that vary from state to state. Nothing in this warranty shall be construed to diminish or restrict any rights you may hold under applicable state law.

By availing this warranty, you agree to waive any other implied or express warranties not expressly stated herein. This Warranty constitutes the entire agreement between you and Husky Concrete Resurfacing regarding the coating product and supersedes all prior or contemporaneous agreements, representations, warranties, and understandings, whether oral or written.
